This agreement ("Agreement") is made and entered into between Pure KNF Foundation, a non-profit organization ("Foundation"), and you, the Research Project Participant ("Participant").
For the purposes of this Agreement, the following terms shall have these meanings:
If my project is accepted by the Pure KNF Foundation, my active participation and reporting obligations under this Agreement shall be from the date of registration through December 31st, 2025. This period represents the active research collection phase only. As detailed in the "Data and Content Rights" and "Data Retention" sections below, the Foundation's rights to use any data, photos, and other content submitted during this period will continue indefinitely beyond this active participation period.
As a participant in the Pure KNF Research Program, I hereby acknowledge that I have responsibilities. I understand that the Pure KNF Research Program has an important purpose of data collection to demonstrate the efficacy of KNF.
During the duration of my project, at a minimum, I will completely and accurately report relevant data through the Weekly Check-in Form online at (web page link). I may also submit other forms, detailing the process and progress of my project.
By participating in this research project, I grant to Pure KNF Foundation a perpetual, worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform all data, photographs, videos, text, and other content ("Content") that I submit, upload, or otherwise provide in connection with my participation in the research project.
This license includes, but is not limited to, the right to:
I represent and warrant that I own or have the necessary rights to grant the license described above for any Content I provide to Pure KNF Foundation. For personal identifying information and images containing identifiable individuals, I acknowledge that appropriate attribution may be provided at Pure KNF Foundation's discretion.
I understand that while Pure KNF Foundation may publish or share my data and content, I retain the right to also use, publish, or share my own research results and content.
I understand and agree that Pure KNF Foundation will retain all Content I submit indefinitely beyond the active participation period of this Agreement. This continued retention is necessary for the Foundation's long-term research objectives, historical documentation, validation of research findings, and potential future research applications.
The Foundation's rights to use, publish, analyze, and share my submitted Content remain in full effect perpetually after the conclusion of my active participation. This perpetual grant of rights is essential to the Foundation's mission of advancing KNF research and education.
I acknowledge that I cannot later withdraw or revoke permission for the Foundation to use Content I have submitted, even after the conclusion of my active participation in the Research Project.
The Foundation reserves the right to terminate this Agreement and a Participant's involvement in the Research Project if:
Upon termination, the Participant may be required to return any unused funds. The Foundation's rights to Content already submitted by the Participant shall survive termination and continue indefinitely as outlined in the "Data and Content Rights" and "Data Retention and Ongoing Use" sections.
The Foundation provides support and guidance but makes no guarantees regarding the success of any Research Project. The Participant assumes all risks associated with their Research Project, including but not limited to crop failure, equipment damage, or other losses.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL THE FOUNDATION BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR IN CONNECTION WITH THE RESEARCH PROJECT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Nothing in this Agreement shall be construed as creating an employer-employee relationship, partnership, or joint venture between the Foundation and the Participant. The Participant conducts their Research Project as an independent researcher.
This Agreement shall be governed by and construed in accordance with the laws of the state where the Foundation is registered, without giving effect to any choice of law or conflict of law provisions.
This Agreement constitutes the entire understanding between the parties with respect to the subject matter hereof and supersedes all prior agreements, oral or written, made with respect to the subject matter hereof.
The Foundation reserves the right to modify this Agreement at any time. Any changes will be communicated to Participants and will be effective thirty (30) days after such notification.
The Pure KNF Foundation provides a website and online platform ("Website") for Participants to submit data, access resources, and interact with the Foundation and other Participants. By using the Website, Participants agree to the following terms:
The Website uses cookies and similar technologies to enhance user experience and functionality. These cookies are necessary for the Website's basic operations, such as maintaining user sessions, authentication, and remembering user preferences. By using the Website, Participants consent to the use of these cookies.
The Foundation does not use cookies for third-party advertising purposes and does not share cookie data with third-party advertisers. The Foundation uses cookies solely for:
In addition to the Research Project data submitted by Participants, the Website may collect standard information such as IP addresses, browser types, referring pages, pages visited, and time spent on the Website. This information is used to monitor and improve the Website, troubleshoot technical issues, and enhance user experience.
The Foundation implements reasonable security measures to protect the information collected through the Website. However, no internet transmission or electronic storage system is completely secure. The Foundation cannot guarantee the absolute security of information transmitted to or from the Website.
The Website may contain links to third-party websites or resources. The Foundation is not responsible for the content or privacy practices of these third-party sites. Participants are encouraged to review the privacy policies of any third-party site they visit through links on the Website.
The Website is not directed to children under the age of 13. The Foundation does not knowingly collect information from children under 13 years of age. If a Participant believes that a child under 13 has provided personal information to the Foundation, please contact the Foundation immediately.
By clicking "I Agree" during the registration process, or by participating in the Research Project, the Participant acknowledges that they have read, understood, and agree to be bound by the terms of this Agreement, including the Website Usage and Privacy terms.
